Background: RubinBrown recognizes jury duty as an important civic and community duty. Policy: Team members who are called for jury duty will be granted, on a short-term basis, to serve in court as a witness or juror and will be compensated based on the guidelines set below. Procedure: Regular status full-time and Flexible Work Program team members working 1000 or more in a fiscal year are eligible for paid witness and jury duty leave from their second day of employment. Temporary team members are not eligible for paid time off for witness or jury duty leave. Regular, full-time and Flexible Work Program team members (as stated above) will be compensated for the difference between their regular pay and their witness and jury duty pay as noted below: Exempt team members will receive their regular salary for each day of witness and jury duty leave. Non-exempt team members will receive eight hours straight time pay for each day of witness and jury duty leave. Hours paid for witness and jury duty leave will not be included in calculating weekly overtime. Flexible Work Program team members will receive a pro-rated percentage of hours worked as compared to a “full time” status (2,080 hours). In the event a team member is summoned to witness and jury duty leave and subsequently is selected to serve as a juror, the team member will be paid by the court. RubinBrown will pay the team member the difference, if any, between regular salary pay and witness and jury duty pay. Team members should, upon receipt of payment from the court, endorse the check and sign it over to “RubinBrown”. This will result in the team member’s pay being uninterrupted. If the check is not submitted within three weeks of the team member’s return from service, Human Resources will authorize a deduction, on the following payroll, of the difference of what the team member earned while serving versus the team member’s base pay rate for said pay period. To qualify for witness or jury leave, team members must immediately submit the summons to their Career Advocate(s) and Human Resources to ensure timely arrangements can be made for alternative staffing arrangements and/or coverage. When business conditions compel, RubinBrown will submit a petition to court to delay or excuse a team member’s jury duty responsibility. Team members will reference on their time sheet any time missed as “Witness and Jury Duty” with the specific number of hours. The Time and Billing code for “Witness and Jury Duty” is 90502 . A team member may be reimbursed for time spent in court as a result of a court witness summons with the approval of the Managing Partner. Each request will be reviewed for individual merit.
