While the decision by the United States Supreme Court recognizes disparate impact, it also mentions that the Fair Housing Act is not an instrument to force state housing agencies to reorder their priorities and that “we must remain wary of policies that reduce homeowners to nothing more than their race.” This will require further interpretation from lower courts and the full effects of the decision have not been interpreted by the state housing agencies or private developers.
